At Sugarman Susskind Braswell & Herrera, we dedicate our practice to pension and employee benefits law, labor law, employment law. We aim to foster environments in which promises made to workers are kept.
Pension and Employee Benefits Law
We offer a wide range of services in the area of employee benefits law, including providing assistance to plan fiduciaries in understanding and complying with their fiduciary obligations in connection with plan governance. We represent the boards of trustees of multiemployer and municipal pension and health benefit plans, helping them comply with legislative and regulatory requirements, offering legal advice on operations matters, and representing them in litigation. We also advise individual employees who have concerns about how their pension benefits have been calculated or how pension plan monies are being managed.
Individual Worker Rights
We represent individual workers asserting claims under the Fair Labor Standards Act (FLSA) for minimum wages and appropriate overtime compensation, including workers who have been misclassified by their employers as salaried rather than hourly workers. We have successfully negotiated severance packages and counseled workers on confidentiality and non-compete agreements. We are also available to advise workers who participate in pension benefit plans and have not received their promised benefits, or who have concerns regarding the management of pension plan assets.
Labor Law
Whether organizing workers, negotiating a contract, enforcing union contracts through arbitration or litigation, or remedying unfair labor practices, we provide committed, full-service representation. We represent labor unions in almost all areas and industries that are organized, whether public or private sector, including teamsters, firefighters, carpenters, nurses, teachers, electricians, office workers, plumbers, and many others.
